1. Agreement

These Terms govern your use of EvrFit, provided by IntegratingMe d.o.o. By creating an account or using EvrFit, you agree to these Terms and the EvrFit Privacy Policy. If you do not agree, do not use the service.

You must be at least 18 years old to create or use an EvrFit account.

2. Wellness service, not medical care

EvrFit is a general fitness and wellness tool. It is not a medical device, healthcare provider, emergency service, or substitute for a qualified professional. Content, plans, scores, summaries, and AI output are informational and may be inaccurate, incomplete, or unsuitable for you.

Do not use EvrFit to diagnose, treat, prevent, or monitor a disease or urgent condition. Consult a qualified clinician before changing exercise, diet, medication, or treatment, particularly if you have an injury, condition, pregnancy, symptoms, or other health concern. In an emergency, contact local emergency services.

Never start, stop, or change medication based on EvrFit output.

3. Your account

You must provide accurate information, keep access credentials secure, and notify us of suspected unauthorized use. You are responsible for activity performed through your account unless the law provides otherwise.

Google Sign-In and Apple platform services are governed by their own terms. You may not create an account for a person under 18.

4. Acceptable use

You must not:

• break the law or infringe another person’s rights;
• upload content you lack the right to use;
• attempt to access another user’s account or data;
• probe, disrupt, reverse engineer, scrape, or overload the service except where law expressly permits;
• use EvrFit or its output for clinical decisions, emergencies, or safety-critical purposes;
• misrepresent AI-generated information as professional medical advice.

5. User content and permissions

You retain ownership of content you submit. You give us a limited, worldwide permission to host, reproduce, process, and transmit it only as needed to provide, secure, improve, and legally operate the service in accordance with the Privacy Policy.

You confirm that you have the right to upload any photo or medical report and that it does not unlawfully disclose another person’s data.

6. Health, Apple Health, and AI features

Apple Health connection is optional and subject to the permissions you select. EvrFit will not use Apple Health data for advertising or data brokerage.

AI features process the information needed for the request through third-party providers identified in the Privacy Policy. AI is probabilistic: identical inputs can produce different outputs, and outputs may contain errors. You must use your judgment and seek professional advice where appropriate.

7. Service changes and availability

We may modify or discontinue features and may perform maintenance. We do not guarantee uninterrupted, error-free, or permanently available service. Where legally required, we will give reasonable notice of material changes.

8. Suspension and termination

You may stop using EvrFit at any time and permanently delete your account from Profile → Account → Delete Account. We may restrict or terminate access for a serious or repeated breach, security risk, unlawful use, or where required by law, subject to applicable consumer rights.

9. Intellectual property

EvrFit software, design, branding, and non-user content belong to IntegratingMe d.o.o. or its licensors. These Terms grant only a personal, limited, non-exclusive, non-transferable, revocable right to use the service for its intended purpose.

10. Disclaimers and liability

To the fullest extent permitted by law, EvrFit is provided “as is” and “as available.” We disclaim implied warranties that may lawfully be disclaimed. We are not responsible for decisions made solely from AI or wellness content.

Nothing in these Terms excludes liability that cannot legally be excluded, including applicable consumer rights, fraud, wilful misconduct, or liability for death or personal injury where exclusion is prohibited.

Legal-review item: add a jurisdiction-appropriate liability cap and exclusions without limiting mandatory consumer rights.

11. Governing law and disputes

These Terms are governed by [GOVERNING LAW]. Courts at [COURTS] will have jurisdiction, except that mandatory consumer law may allow you to bring a claim elsewhere.

12. Apple terms

If you download EvrFit through Apple’s App Store, Apple is not responsible for providing or supporting EvrFit except as required by law. Apple and its subsidiaries are third-party beneficiaries of these Terms. These Terms supplement, and do not replace, applicable Apple media-services terms and the licensed application end-user licence agreement selected in App Store Connect.
